Scope of Warranty

This warranty covers the installation of the fence completed by Sunbury Fencing, herein referred to as the “Installer,” for a period of Two-Years from the date of the completed installation. The warranty ensures that the fence installation is free from defects in workmanship and materials under normal use and service.

Coverage

During the warranty period, the Installer will repair or replace, at its discretion, any defective workmanship or materials identified by the customer. This warranty does not cover damage caused by accidents, misuse, abuse, acts of nature, or alterations made to the fence by parties other than the Installer.

Exclusions

This warranty does not cover:

  • Normal wear and tear.
  • Damage resulting from improper maintenance or neglect.
  • Damage caused by unauthorized repairs or modifications.
  • Acts of vandalism or intentional damage.
  • Damage caused by improper installation of the fence by parties other than the Installer.

 

Wood Fencing and Decking Warranty

Warranty is on workmanship only. Not material.

As wood is a natural substance, we can not warranty against natural seasoning (sun, rain, heat/cold) of the product. I.E. Shrinkage, warpage, cracking are not considered workmanship and are not warrantable. If using straight edge or tongue & groove boards, gapping will occur due to shrinkage. Sunbury recommends application of a staining product as early as possible while obeying the stain manufacturer’s recommended timelines with regards to moisture. Natural wood products are subject to variations in grain, colour and minor blemishes.  The finished product may therefore appear different from samples or photographs.  Mill grading marks may appear on the lumber in the form of grade stamps or chalk/crayon strokes. Rough or smooth timber may have chain stains.                                                                                                  

Vinyl, Composite, Metal, and Chainlink Fencing Warranty

Sunbury warranty on workmanship and manufacturer warranty on materials.

Claim Process:

To make a warranty claim, the customer must notify the Installer in writing within the warranty period of discovering the defect. The customer must provide proof of purchase and allow the Installer reasonable access to inspect and remedy the issue. The Installer reserves the right to charge for service calls related to issues not covered by this warranty.

Limitation of Liability

The Installer’s liability under this warranty is limited to the repair or replacement of defective workmanship or materials as specified herein. In no event shall the Installer be liable for any incidental, consequential, or special damages arising out of or in connection with the installation of the fence.

Transferability

This warranty is transferable and applies to whomever owns the property.

Governing Law

This warranty is governed by the laws of British Columbia and any disputes arising out of or related to this warranty shall be resolved through arbitration in British Columbia

Entire Agreement

This warranty constitutes the entire agreement between the customer and the Installer regarding the fence installation and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written.

Effective Date is the date of the last invoice sent by Sunbury for the completion of the job.
